Fatal crash in Missouri leads to drunk driving allegations

Motor vehicle accidents can happen at any moment of the day. While some are the result of a driver who is under the influence, many accidents occur due to a single moment of distraction. Unfortunately, police believe that drunk driving was a factor in a recent accident in Missouri that resulted in a fatality.

The incident reportedly happened during the evening hours of a day in late August. According to reports, a 43-year-old man was driving a pickup truck when the vehicle crossed the centerline. Unfortunately, police say that they vehicle then struck a 26-year-old male motorcyclist head on.

The motorcyclist died at the scene while the driver of the pickup was transported to the hospital for treatment of minor injuries. Though police believe that the pickup driver was under the influence of alcohol at the time, it is unclear what led them to this belief or what evidence supports it. Initially charged with felony resisting arrest and felony DWI, he was later charged with second-degree murder.

An unexpected death such as this is always a tragedy and the desire to hold someone responsible is understandable. Despite this, there must be sufficient evidence to prove that someone is guilty beyond a reasonable doubt in order for the accused individual to be convicted in Missouri and across the country. Because of this high standard, it is sometimes difficult to meet the burden of proof demanded by a criminal court. An attorney with experience with cases involving allegations of drunk driving can help the man sort through the evidence against him and create an appropriate plan of action.
