DWI CHARGES FOLLOW MISSOURI CAR ACCIDENT

It seems that a great deal of important decisions are made based on a person’s actions following a car accident. Unfortunately, one Missouri man is now facing a DWI charge following a crash that sent him and his passenger to the hospital.

The crash happened in the early morning hours of a day in January. According to reports, a car driven by a 25-year-old male crashed into an embankment before overturning. Both the driver and his passenger were transported to the hospital. His passenger suffered a broken arm in the crash.

Police say that the driver performed poorly on assessments apparently intended to determine his sobriety. They also claim that he admitted to having several drinks prior to the accident. A Breathalyzer reportedly revealed that his blood alcohol content was above the legal limit. A month after the accident, the driver was charged with driving while intoxicated with serious physical injury.

In order to gain a conviction of a DWI or other criminal charges, Missouri prosecutors must prove guilt beyond a reasonable doubt. Unfortunately, many of the tools that officials claim indicate that a person is under the influence of drugs or alcohol could be flawed. A poor performance on certain verbal tests could be due to shock following a crash while breath test results could be inaccurate. Both assessments are subject to human error.
