SEVERAL PEOPLE TELL DIFFERENT STORIES RE SUSPECTED RAPE INCIDENT

A group of people who apparently gathered together on Super Bowl Sunday 2016 are now being questioned by authorities with regard to a suspected sexual assault that supposedly took place that day. Specifically, one of those involved, a 27-year-old man, is accused of felony rape. A 54-year-old man was also reportedly arrested in connection with the Missouri incident.

The man charged with attempted rape apparently told police that he did have sexual relations with the woman in question, but it was consensual. He claims that he was high at the time due to methamphetamine smoke that another woman and the man who was also arrested had blown in his face. He reportedly stated that his memory of the events as they unfolded is foggy due to the effects of the drug smoke.

The man purportedly told police that he has no recollection of the 50-year-old woman telling him that she did not want to have intimate relations with him. He also said that the other man had suggested the idea, telling him that if he engaged in sex with the woman, it would be considered payment for drugs. The other man was taken into custody and charged with possession of a controlled substance.

Being accused of felony rape in Missouri carries potentially severe penalties if convicted. When several people are involved and each of the recorded accounts of what happened varies, an experienced criminal defense attorney can often pursue that fact to the benefit of a client. In many situations, there are aspects of the charges or the process of an arrest that can be legally challenged in court.
